50 50 Raffle Rules in California

If you plan to hold a random draw or occasional sweepstakes for your fundraiser this year, we`d like to let you know about important compliance requirements under California state law as well as federal income tax law. The financial form, informative FAQs, and other information about organizing sweepstakes in California is available on the state`s website. If participants need to purchase a ticket for a chance to win a prize, the draw is subject to the provisions of ยง 320.5 of the Penal Code and the associated provisions as a contest. If we are required to report winning winnings to the IRS, we must complete a tax identification form (Form 5754) of the prize winner before participating in the prize procession. Any raffle or occasional draw brochure (distributed to customers prior to a draw) describing the prizes and their value must also have a language indicating that the winner of the prizes in the draw may be subject to the declaration of gambling winnings and withholding income tax. We don`t want our customers to be surprised. ELIGIBILITY: The Foundation 50/50 Contest is open to all ticket holders (excluded below) at San Jose Sharks home games who: (i) are eighteen (18) years of age or older at the time of entry; (ii) are physically present on the Site to purchase tickets, and (iii) present a valid government-issued ID. By purchasing a raffle ticket, the participant agrees to comply with all the terms and conditions of these Official Rules, which are subject to all federal, state, local and local laws and regulations. Only one winner per draw. Some restrictions apply. In the event of a discrepancy between the advertised number and the actual number, the actual number drawn will be considered a valid winning ticket. The Foundation is not obliged to contact the winner directly.

PRIZE: Each prize is in cash and the amount depends on the number of raffle prizes sold on a given match day. Any winning prize in the form of a check will be paid to the respective winner of the Prize Draw within four (4) to six (6) weeks from the date of the complaint by U.S. mail or national courier, once the potential winner has submitted all documents required by the Foundation and applicable law. Each Contest winner will receive half (or 50%) of the total amount received from the Contest Ticket Sale by the Foundation on the day for which their winning number was selected (the “Prize”). The final amount of the prize displayed on the Website, on the Website and/or in the winner`s affidavit may be adjusted by the Foundation based on the final determination of the funds actually collected during the sale of raffle tickets, technical errors in the draw or other factors affecting the prize amount. Therefore, the winner`s check may be less than the amount advertised during the game. Only one prize cheque will be awarded by draw and a prize cannot be divided into several cheques. No replacement of the cash prize is allowed. The 50/50 raffle ticket purchased is the only valid receipt for claiming a prize. The original ticket must be submitted and reflect the winning number. A photocopy, photo or reproduction of the receipt will not be accepted.

An individual presenting a winning ticket to the Contest (“Potential Winner”) must submit their valid Social Security Number and equivalent identification to the Foundation and complete and return an affidavit, a release of liability and disclosure, as well as all applicable tax forms, as well as any other information requested by the Foundation to determine eligibility and comply with applicable laws. are mandatory. Once the relevant documentation has been completed and eligibility verification has been verified, the Foundation will send the winner a cheque for the winner`s amount within approximately four to six weeks. Any unclaimed prizes will be forfeited and will be donated to the foundation or non-profit organization designated for the appropriate draw.

All post-season prizes, if any, must be claimed within thirty (30) days of the draw. Any post-season prize that is not claimed after thirty (30) days will be forfeited and given to the Foundation or charity designated for the relevant prize draw. The Foundation and the indemnified parties are not responsible for the loss or theft of raffle tickets 50/50. APPLICABLE LAWS: The 50/50 draw is governed by California law through the Department of Justice`s Major League Sports Sweepstakes Program. All contest winners are subject to the rules and regulations of the Internal Revenue Service (“IRS”) and the California Franchise Tax Board regarding gaming winnings. The Foundation must comply with all reporting obligations on prize amounts imposed by state, local and/or federal laws. Each winner assumes full responsibility for all taxes, fees or other state, local or federal assessments on the prize amount. The Federal Tax Act stipulates that prior to the distribution of the prize, a withholding tax on certain contest values must be levied on the winner. Each winner is advised to consult their own tax advisor about the obligations that may result from winning a prize in the 50/50 draw.
